TERMS of SERVICE

By ordering my commission, you have read and agreed to these following terms.

First of all, please understand that i have the right to:
- Decline your commission request due to personal reasons.
- Alter my Terms of Service at any time (new rules will not apply retroactively and won't influence orders started on older terms).

1. Copyrights and Permissions

THE ARTIST@kaithekoala1000 reserves all copyrights and related rights for all of the finished commission and preliminary materials produced during the working process, which include but is not limited to:
- Self-promotion
- Publishing on social media/portfolio as commission samples (with client's name).
- Distribution & reproduction (feature in artbook with client's permission).
- Other copyright that entitled to in accordance with international law.THE CLIENTCommissioner can only use the commission for personal purposes, including:
- Reposting or using as icon/avatar/header/cover on non-profit social media site with credit given to the artist (@kaithekoala1000 or profile link).
- Using as pc wallpaper or gift for friends.
- Printing in a small amount (less than 10 pieces per artwork) for personal use.Commissioner can not:
- Claim as your own drawing and take away the artist's credit.
- Use the provided preliminary materials (sketch, color draft, ...) for any other purpose beside commissioning the artist and personal uses.
- Trace, edit, reproduce or make profit from the commissions.
- Use for competitions, non-fungible tokens (NFT), blockchain, crypto currency, AI image generators and any other future inventions of these technologies.

2. Payment

The client can choose between two options below:

- For commission under 100USD: upfront 100% payment.
- Payment plan is optional for commission above 100USD: 50% upfront and 50% after sketch approval.
- Commission paid earlier will be prioritized.

3. Refund

FULL REFUND if:
- The commission was canceled before I start working on it.
- Full refund = the net amount I received after Paypal transaction fee deduction.50% REFUND if:
- The commission was canceled after sketch approval, before working on the lineart.
- When a Payment plan is applied, it is possible to cancel at delivery of the sketch, the 50% upfront payment will not be refunded.NO REFUND if:
- The commission was canceled in the middle of the process (lineart, colored,...) or after delivery of the final artwork.
- Please always contact me first if you have to resolve any issue with the commission. Do not file chargebacks under any circumstances.

4. Process

DEADLINE
- Time between sketch and finished piece is around 1 to 4 weeks or depending on the schedule we agreed on. Please be patient.
- If the commission deadline needs to be extended, the client will be informed beforehand.
- Extra fee will be added for a tight deadline.WORKFLOW
Process is divided into 4 stages:
1. brief approval ➜ 2. sketch (colored) ➜ 3. lineart | base color ➜ 4. finished artworkThe finished artwork will be delivered via email or google drive link. File details:
- .png image format of highest resolution (300dpi).
- Include a small watermark/signature.
The working files (.psd) will not be attached.REVISIONS
Please make sure to check the process content carefully and give feedback between stages as soon as possible to prevent any dissatisfaction.1. Brief approval: unlimited revisions.
- Free suggestions from the artist to fit the client's requirement.
- Include rough idea sketch if needed.
- The discussion may take a long time depending on the client's decision.2. Sketch: 3 revisions.
- Free revisions are limited to what was agreed upon in the brief approval stage and minor changes.
- Additional fee will be charged if require redrawing some of these major changes: pose & outfit change, composition change, additional background, etc.3. Lineart | base color: 3 revisions.
- Revisions apply to mistakes from the artist such as missing details on references or requests.
- The client can make changes to the colors if needed.4. Finished artwork: 1 revision.
- Only very small changes can be made.

HOW TO ORDER

Remember to read the TERMS of SERVICE carefully before commissioning.

To place an order, please understand that:
- The client needs to provide both visual and text information based on the commission form below.
- If the client wants to order multiple commissions, please make sure to separate the forms by number (Commission 1, Commission 2, ...) and send them in the same email.

FOR ILLUSTRATION COMMISSION

- Description: number of characters; desired poses, expressions, perspective, color palette, etc...
- Background/weapons/items/pets:
- References: visual or detailed text description of the characters: appearance, personality, lore, special trait, outfits, etc...; moodboards; toyhou.se link; etc...
- Other requests: private commission, deadlines, details to take note/avoid, etc...FOR CHARACTER DESIGN COMMISSION
- Confirm: I have read and agreed to the Terms of Service.

- Commission type: character/outfit design
- Description: character's lore, profile, personality, traits, skills; desired fashion style, color palette, custom logo/frame, etc...
- Weapons/items/pets:
- Character sheet include: portrait; full body: front, back, side; characters' details; accessories; expressions; weapons/items/pets; etc...
- References: moodboards, aesthetics, fashion styles, design element, etc...
- Other requests: private commission, deadlines, details to take note/avoid, etc...You can send me the commission form through

COMMISSION PRICE

Convert to VNĐ: total price x 23.000VNĐ.
Private commission (hidden on public sites): + 30% total price.
Character design commission: + 50% total price. The work process for this type of commission will be slightly different than illustration commission. Details will be shared more carefully before starting.All prices below are starting prices apply for illustration commission with 1 character only and may not represent the final price of a particular commission. Prices can be raised based on character & background complexity.
